1. About these Terms
www.mushimush.com (the "Website") is owned and operated by Mushimush Skin Pvt. Ltd. (CIN: U20237PN2026PTC254089), a company incorporated in India, with its registered office at Row House Prince 7, Palace Orchard Society, NIBM Road, Pune 411060, Maharashtra, India ("Mushimush", "we", "us", "our").
These Terms of Use ("Terms") govern your access to and use of the Website and any purchase you make through it. They should be read together with our Privacy Policy, Shipping Policy and Returns & Refund Policy, all published on the Website (together, the "Policies"). The Policies form part of these Terms.
"You" or "User" means any person who visits, browses or buys from the Website.
By accessing or using the Website, you confirm that you have read, understood and agree to these Terms and the Policies. If you do not agree, please do not use the Website.
We may update these Terms from time to time by posting the revised version on this page with a new "Last updated" date. Changes take effect when posted. Continuing to use the Website after that means you accept the updated Terms, so please check this page periodically. Orders already placed are governed by the Terms in force when the order was placed.
2. Privacy
Your personal information is handled as described in our Privacy Policy. By using the Website, you consent to that use.
3. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract under Indian law to buy from the Website. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian.
If you use the Website on behalf of another person, you confirm you are authorised to accept these Terms for them.
4. Accounts and Guest Checkout
You may shop as a guest or create an account. If you create an account:
- Provide accurate, current details and keep them updated.
- Keep your login credentials confidential. Do not share your account.
- You are responsible for all activity under your account, unless it results from our failure to secure our systems.
- Tell us immediately at info@mushimush.com if you suspect unauthorised use.
We may suspend or close an account that we reasonably believe is being misused, used fraudulently, or used in breach of these Terms.
5. Using Our Products Safely
Our products are cosmetics for external use only. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease.
Skin is individual. A product that works well for one person may not suit another, and any ingredient can cause a reaction in some people. Before use, please:
- Read the full ingredient list, directions and cautions on the pack and product page.
- Do a patch test on a small area of skin 24 hours before first use.
- Stop using the product and seek medical advice if irritation, redness, swelling or any other reaction occurs.
- Consult a doctor or dermatologist first if you are pregnant, breastfeeding, have a skin condition, or have known allergies.
Results vary between individuals. Descriptions of benefits, including protection against blue light from screens, reflect the intended action of the formulation and are not a guarantee of any particular result for you.
6. Limitation of Liability
The Website and its content are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties beyond those expressly stated in these Terms or on the product packaging.
To the extent permitted by law, we are not liable for:
- a reaction caused by an ingredient listed on the product, where the product was used contrary to its directions or cautions, or without the patch test recommended above;
- interruptions, delays or errors in access to the Website;
- viruses, malfunctions or data loss arising from your use of the Website or linked sites;
- indirect, incidental, special or consequential losses, including loss of profit or business;
- events beyond our reasonable control (see Section 17).
Where we are found liable for any loss relating to an order, our total liability will not exceed the amount you paid for that order.
Nothing in these Terms limits any right you have as a consumer under the Consumer Protection Act, 2019 or any other law that cannot be excluded by contract.
7. Product Information
We take care to describe our products accurately. Product images are for illustration; colour, texture and packaging may differ slightly from what you see on screen. If we find an error in a description, we will correct it as soon as possible.
8. Pricing
All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Shipping charges, if any, are shown at checkout before you pay.
Prices and availability may change without notice. A change will not affect an order we have already confirmed, except in the case of an obvious pricing error described in Section 9.
The MRP printed on a pack reflects the price declared at the time of manufacture. The selling price on the Website may be lower than the printed MRP, and will never be higher.
9. Orders
Placing an order is an offer to buy. A contract is formed when we send an order confirmation by email or SMS.
We may decline or cancel an order, before or after confirmation, if:
- the product is out of stock or discontinued;
- the price or description was clearly wrong because of a technical or typographical error;
- we cannot deliver to your address;
- we reasonably suspect fraud or misuse, including misuse of offers or discount codes.
If we cancel an order you have paid for, we will refund the full amount to your original payment method in line with our Returns & Refund Policy.
10. Payment
We accept credit cards, debit cards, UPI, net banking and wallets, processed through secure third-party payment gateways. We do not store your full card details.
Partial Cash on Delivery (COD): For eligible orders, you pay part of the order value online at checkout and the balance in cash or by UPI on delivery. The prepaid amount, eligible products and serviceable pin codes are shown at checkout and may change. If a partial COD order is refused at delivery without a valid reason, we may retain the prepaid amount to cover shipping and handling costs, as set out in our Returns & Refund Policy, and may restrict COD on future orders.
11. Shipping, Returns and Refunds
Delivery timelines, shipping charges, returns, cancellations and refunds are governed by our Shipping Policy and Returns & Refund Policy published on the Website.
12. Intellectual Property
All content on the Website, including the Mushimush name and logo, product names, text, images, videos, graphics and design, belongs to Mushimush Skin Pvt. Ltd. or its licensors and is protected by Indian intellectual property law.
We grant you a limited, personal, non-transferable licence to view the Website and buy products for your personal, non-commercial use. You may not copy, reproduce, modify, sell or otherwise use any content without our prior written consent. All other rights are reserved.
13. Acceptable Use
You agree not to:
- use the Website for any unlawful or fraudulent purpose;
- access, or attempt to access, accounts, systems or data not intended for you;
- probe, scan or test the Website's security, or upload viruses or harmful code;
- disrupt or overload the Website, or interfere with other users;
- use bots, scrapers or automated tools to collect data from the Website;
- post reviews or content that is false, misleading, defamatory, obscene or infringes anyone's rights;
- buy products for resale without our written consent.
We may investigate breaches and cooperate with law enforcement where required.
14. Reviews and Promotions
By submitting a review, photo or other content to the Website, you confirm it is your own, honest and lawful, and you allow us to display and use it on our Website and marketing channels without payment. We may moderate or remove content that breaches these Terms.
Contests, offers and discount codes may carry their own terms, which will be shown with the promotion and apply in addition to these Terms.
15. Third-Party Links
The Website may link to third-party websites or services, such as payment gateways or courier tracking. We do not control or endorse them and are not responsible for their content or practices. Please review their own terms and privacy policies.
16. Indemnity
You agree to compensate us for losses, claims and reasonable legal costs arising from your breach of these Terms or your misuse of the Website.
17. Events Beyond Our Control
We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, riots, strikes, government action, or failures of the internet, telecom or courier networks.
18. Suspension and Termination
You may stop using the Website at any time. We may suspend or end your access if you breach these Terms or misuse the Website. Termination does not affect orders already placed, amounts owed, or rights and obligations that by their nature continue (including Sections 6, 12, 16 and 19–20).

We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt.
If a dispute is not resolved this way within 30 days, either party may refer it to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement of both parties, or, failing agreement, as provided under that Act. The seat and venue of arbitration will be Pune, Maharashtra, and the proceedings will be in English.
This clause does not stop you from approaching a consumer commission under the Consumer Protection Act, 2019, and does not stop either party from seeking urgent interim relief from a court.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to Section 19, the courts at Pune, Maharashtra will have exclusive jurisdiction.
21. Electronic Communications
You agree to receive order confirmations, notices and other communications from us electronically, by email, SMS, WhatsApp or by posting on the Website. These satisfy any legal requirement for communication in writing. Marketing communications are separate, and you can opt out of them as described in our Privacy Policy.
22. General
- These Terms and the Policies are the entire agreement between you and us about the use of the Website.
- If any provision is found invalid, the rest remains in force.
- Our not enforcing a provision is not a waiver of our right to enforce it later.
- Nothing in these Terms creates a partnership, agency or employment relationship between you and us.
- You may not transfer your rights under these Terms. We may transfer ours to an affiliate or successor business.
